By using the platform, you represent and warrant that you have full legal capacity, power and authority to enter into this agreement and to perform your obligations hereunder. You further confirm that you are not subject to any legal, contractual or other restriction that limits or prevents your ability to accept these terms and conditions. You warrant that you will use the platform in accordance with applicable laws and regulations and that your use will not infringe any third party rights or contravene any applicable regulations.
Your acceptance of this agreement constitutes a binding commitment by you and any entity you represent to adhere to the terms set forth herein and any additional policies posted on the platform. This commitment includes your obligation to ensure that all information provided during registration and use of the platform is truthful, accurate and up to date. Wishlist Calendar will not be liable for any breach of these terms by users, and any violation of these terms may result in the suspension or termination of your access to the platform.
By registering and using the services offered by Wishlist Calendar, the user expressly accepts and authorizes the platform to send notifications, messages, and communications to the email address provided at the time of registration or subsequently updated in their user profile. These communications may include, among others, registration confirmations, updates on the status of your account, notifications related to payments received or made, reminders of activities or events scheduled on the calendar, technical or security notices, relevant changes to the terms and conditions or privacy policy, as well as operational information necessary for the proper functioning of the platform.
Likewise, the user may occasionally receive informational or promotional communications related to new features, service improvements, campaigns, or special events organized by Wishlist Calendar. At any time, the user will be able to manage their communication preferences, including the option to unsubscribe from communications that are not strictly necessary for the provision of the service. However, certain notifications of a transactional, technical, or legal nature may continue to be sent as they are essential for the management of the user's account and the fulfillment of contractual obligations acquired through the use of the platform.
To access and use the features of Wishlist Calendar, users must register on the platform by creating a personal account. Registration can be done as a Creator ("Wisher"), which allows you to publish and manage a calendar with wish lists visible to other users, or as a Fan ("Gifter"), which allows you to explore published calendars and make financial contributions to support the wishes of Creators.
The user declares and guarantees that all information provided during the registration process is true, accurate, current, and complete, and agrees to keep their account information up to date at all times.
Each user is responsible for maintaining the confidentiality of their login credentials and for the use of their account, whether by the account holder or unauthorized third parties. Wishlist Calendar shall not be liable for any unauthorized access or misuse of the user's account resulting from a breach of this obligation. The user undertakes to immediately notify Wishlist Calendar of any unauthorized access, suspected security breach, or misuse of their account.
Wishlist Calendar reserves the right to suspend, restrict, or cancel a user account at any time and without prior notice if it detects fraudulent behavior, misuse of the platform, or violations of these terms and conditions or applicable law. Likewise, the use of multiple accounts by the same individual for manipulative or abusive purposes or contrary to the legitimate operation of the platform is prohibited.
The user may cancel their account at any time by accessing their profile settings or by sending an express request to the contact details provided. Cancellation of the account implies the deletion of the visible data associated with the profile, as well as the deactivation of access to the platform's features. However, certain data may be retained for the time strictly necessary to comply with legal, contractual or administrative obligations in accordance with the provisions of the privacy policy. Registration with Wishlist Calendar implies full acceptance of these terms and conditions and the user's commitment to make responsible and lawful use of the services offered.
Wishlist Calendar allows registered users as Creators ("Wishers") to create and manage a personal calendar with wish lists, through which they can voluntarily and publicly share their actual plans and everyday aspirations. These plans can include activities of any nature, such as going out for coffee, a concert, a trip, a personal care experience, among others. The purpose of this feature is to offer followers or Contributors ("Gifters") the possibility of viewing these plans and supporting them financially through direct contributions, in order to help make them a reality.
By using this feature, the Creator agrees that the content posted on their calendar must be truthful, respectful, consistent with the purposes of the platform, and may not include false, misleading, or inappropriate information. The Creator also acknowledges that all financial contributions received through their calendar are processed by Stripe, an external payment platform, and are subject to Stripe's terms of use and compliance policies.
Wishlist Calendar expressly prohibits the inclusion of gifts, requests, or plans that violate Stripe's usage policies or are inappropriate for the purpose of the platform. It is strictly prohibited to post gifts or plans related to any of the following categories on wish lists:
The Creator is solely responsible for the content of their calendar and the consequences of its publication. Wishlist Calendar reserves the right to remove, suspend or restrict any calendar, plan or request that contravenes these provisions, as well as to suspend or cancel the account of the offending user, without prior notice, when activities incompatible with the lawful purpose of the platform or with the rules imposed by the payment service providers used are detected.
Registered users as Fans ("Gifters") may make voluntary payments to support wishes included in calendars published by Creators ("Wishers"), using the payment methods enabled through the platform. All payments are securely processed by Stripe, a third-party provider specializing in payment processing services. By making a payment, the Gifter authorizes Stripe to charge the amount to the selected payment method and expressly agrees to the terms of use, privacy policies, and applicable rules of that third-party provider.
The amount contributed by the Gifter is transferred directly to the Creator's associated Stripe account, less the applicable service fee. Wishlist Calendar applies a flat fee of ten percent (10%) on each transaction, which is borne entirely by the Gifter. Creators do not pay commissions and receive one hundred percent (100%) of the net value of payments made through their wish page. Wishlist Calendar does not manage or retain funds at any time and will not be responsible for transfer times or incidents arising from bank management or Stripe's internal procedures.
The Gifter understands that any payment made constitutes a voluntary contribution intended solely to support the personal activities, experiences, or goals expressed by the Creators, and that such contributions do not constitute the purchase of goods or the contracting of services. Wishlist Calendar does not guarantee the execution, fulfillment, or accuracy of the plans published in the calendars, nor does it monitor the use that Creators make of the funds received. All payments are final and non-refundable, except as otherwise provided by applicable law or expressly by Stripe in its sole discretion. By making a payment, the Gifter agrees to be bound by these terms and conditions in their entirety.
By publishing, uploading or sending any type of content through the platform, including but not limited to calendars, wish lists, descriptions, titles, images, links, comments, usernames, profile photos and any other visual, textual or audiovisual information generated by the user themselves ("User Content"), Wishlist Calendar users grant Wishlist Calendar a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, reproduce, distribute, publicly display, communicate, modify, and adapt such content for the sole purpose of operating, promoting, and improving the services offered by the platform, as well as to comply with technical and legal obligations.
The user acknowledges and agrees that they are solely and exclusively responsible for all content they publish, guaranteeing that they have all the necessary rights to authorize its use in accordance with these terms. The user undertakes not to publish content that is unlawful, defamatory, misleading, abusive, violent, threatening, obscene, sexually explicit, discriminatory, infringes the rights of third parties, including intellectual property or image rights, or in any way contravenes the legitimate purpose of the platform. Wishlist Calendar is not responsible for the content posted by users and assumes no obligation to monitor or moderate such content in advance, without prejudice to its right to remove or suspend any content that, in its sole discretion, it deems inappropriate, offensive, misleading, or contrary to these terms and conditions.
Likewise, the user declares that the content they publish does not infringe any law, agreement, community rule or third-party rights, and exempts Wishlist Calendar from any claim, damage or harm that may arise from the use or dissemination of such content. Wishlist Calendar reserves the right to suspend or cancel, without prior notice, access to the account of any user whose content violates these provisions or affects the proper functioning, reputation, or purposes of the platform. By using Wishlist Calendar, the user expressly accepts these conditions and assumes full responsibility for the content they generate and share.
Wishlist Calendar is a web platform that allows users to create, share, and support wish lists linked to a personal calendar. The platform acts exclusively as a technological intermediary that facilitates interaction between Creators ("Wishers") and Fans ("Gifters"), without participating in the execution, verification, or control of the plans, activities, or wishes published, or the use that Creators make of the funds received. In this regard, Wishlist Calendar does not guarantee the accuracy, truthfulness, completeness or authenticity of the content generated by users, nor does it assume any responsibility for the effective realization of the plans published in the calendars or the satisfaction of the expectations of Fans/Gifters with respect to the contributions made.
Wishlist Calendar does not offer products or services on behalf of Creators, nor does it act as an agent, representative, guarantor or beneficiary of any of the parties. All financial contributions made by Fans/Gifters through the platform are voluntary and final, and do not entitle them to any refund, consideration, participation, benefit or claim whatsoever regarding the Creator's activity or the destination of the funds. The Fan/Gifter understands and accepts that any payment made is purely symbolic and supportive in nature, and is made at their own discretion and responsibility, without Wishlist Calendar being held responsible for the use, management, or results derived from such contributions.
Wishlist Calendar uses third-party services, such as Stripe, for secure payment processing. The platform does not retain or manage funds at any time and assumes no responsibility for delays, technical failures, transaction errors, commissions, refunds, or any other aspect related to payment processing or the transfer of funds, which are governed by the terms and conditions of such third-party providers. Furthermore, Wishlist Calendar does not guarantee uninterrupted, error-free, or secure access to the platform, and is not responsible for service interruptions, data loss, technical failures, cyber-attacks, system errors, delays, or any other event that prevents or affects the use of the platform for reasons beyond its reasonable control.
In no event shall Wishlist Calendar, its directors, employees, affiliates, agents or providers be liable for any direct, indirect, incidental, special, consequential or punitive damages resulting from the use or inability to use the platform, the conduct of other users or any content posted on the calendars. This limitation of liability shall apply to the fullest extent permitted by applicable law, even if Wishlist Calendar has been advised of the possibility of such damages.
By using the platform, the user expressly agrees that they do so at their own risk and responsibility, and that Wishlist Calendar makes no warranties of any kind, whether express or implied, regarding the suitability, availability, accuracy, reliability, or security of the platform and its features. Any decision made based on the content, interaction with other users, or financial contributions made is understood to be made at the sole discretion of the user, who exempts Wishlist Calendar from any liability arising from such actions.
All content on Wishlist Calendar website, including, without limitation, names, logos, trademarks, images, text, graphics, videos, photographs, illustrations, software and other items are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Wishlist Calendar or by third parties who have licensed or provided their material to the website. You acknowledge and agree that all materials on Wishlist Calendar are made available for limited, non-commercial, personal use only. Except as specifically provided herein. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Wishlist Calendar prior express written permission.

Any dispute, claim or controversy arising between a user and Wishlist Calendar in connection with these terms and conditions, the use of the website or the services provided, shall be resolved exclusively through alternative dispute resolution mechanisms, including mediation and arbitration, as detailed below.
First, both parties agree to use their best efforts to resolve any dispute informally. This includes direct communication between the parties involved to identify and address concerns or disagreements quickly and efficiently. Users may contact Wishlist Calendar through designated support channels to raise any disputes. The company commits to respond within a reasonable period of time, providing an opportunity to resolve the issue without resorting to formal procedures.
If the parties fail to resolve the dispute informally within thirty (30) days of initial notification of the dispute, the dispute will be submitted to mediation. The mediation shall be conducted before a neutral mediator selected by mutual agreement of the parties. If the parties are unable to agree on a mediator within an additional fifteen (15) days, a mediator shall be appointed through a recognized mediation agency. The costs of the mediation shall be shared equally between the parties, and the mediation shall be conducted in English and at a mutually agreed location or, if both parties agree, through a virtual platform.
If mediation does not result in a satisfactory resolution for the parties, the dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of an internationally recognized arbitration institution. The arbitration shall be conducted by a single, neutral arbitrator, who shall be selected in accordance with the rules of the arbitration institution. The place of arbitration shall be Spain. The language of the arbitration shall be English.
The arbitrator shall have exclusive authority to resolve the dispute, including determining the applicability and validity of these dispute resolution terms. The arbitrator's decision shall be final and binding on both parties, and may be entered as a judgment in any court of competent jurisdiction. Unless prohibited by applicable law, the parties agree to waive any right to bring the dispute in court or to participate in a class action.
This dispute resolution clause does not preclude Wishlist Calendar from seeking injunctive or equitable relief in the event of intellectual property rights infringement, misuse of the platform, or any act that may cause irreparable harm, in which case it may go directly to a court of competent jurisdiction without exhausting alternative dispute resolution mechanisms.
By accepting these terms, users expressly waive any right to a jury trial and agree that all disputes will be resolved in accordance with the procedures set forth in this clause, with the objective of minimizing the costs and time associated with formal litigation. The parties assume their own costs associated with mediation and arbitration, unless otherwise agreed or specifically provided by the arbitrator.
The Wishlist Calendar platform is available worldwide, therefore these terms and conditions shall be governed by and construed in accordance with international law, specifically the laws of Spain and the European Union. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the courts of Spain.
